Plain-language summary: By using Evolia Health’s website or purchasing our products, you agree to these terms. Our products are educational tools — they do not constitute medical, legal, or regulatory compliance advice. Digital products are non-refundable once downloaded. Our content is licensed for your use, not for resale or redistribution. For enterprise buyers, your customization rights are defined in Section 15.
1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your access to and use of evoliahealth.com (the “Site”) and all products, services, and content made available by Evolia Health (“Evolia Health,” “we,” “us,” or “our”). By accessing the Site, placing an order, or using any Evolia Health product or service, you agree to be bound by these Terms.
If you are using the Site or purchasing on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms. References to “you” include both individual users and organizations where applicable.
If you do not agree to these Terms, you must discontinue use of the Site immediately and must not purchase any products or services.
These Terms are supplemented by our Privacy Policy, which is incorporated herein by reference.
2. Products & Services
Evolia Health offers the following categories of products and services:
2.1 CWPS — Climate Workforce Protection System
Occupational environmental health toolkits designed for purchase and implementation by employers, government entities, and organizations. CWPS products provide science-based frameworks, standard operating procedure templates, training materials, and related resources. These products are tools to support the development of a health and safety program — they do not constitute legal compliance certification, OSHA approval, or professional engineering or legal services.
2.2 Enterprise Engagements
Custom scoping, discovery calls, and tailored implementations for government entities and large organizations. Enterprise engagements are governed by a separate Statement of Work or service agreement in addition to these Terms.
3. Purchases & Payment
All purchases on the Site are processed through WooCommerce using a third-party payment processor. By placing an order, you represent that:
- You are authorized to use the payment method provided
- The billing information you submit is accurate and complete
- You are at least 18 years of age or purchasing on behalf of an organization
All prices are listed in U.S. Dollars (USD). Evolia Health reserves the right to update pricing at any time without advance notice. Price changes will not affect orders already confirmed.
Applicable taxes may be collected based on your billing address and applicable state and local law. You are responsible for any taxes, fees, or duties imposed by your jurisdiction in connection with your purchase.
4. Digital Products & Downloads
Evolia Home bundles and other digital products are delivered via secure download link following purchase. You are responsible for downloading and saving your purchased files. Evolia Health cannot guarantee indefinite availability of download links; we recommend saving your files immediately upon receipt.
If you experience a technical problem accessing your download after a confirmed purchase, contact us at contact@evoliahealth.com within seven (7) days of your order date and we will make reasonable efforts to resolve the issue.
5. Refund Policy
Digital products are generally non-refundable once downloaded. Because our products are delivered digitally and their value is immediately accessible upon download, we cannot offer refunds once a file has been accessed or downloaded.
Exceptions to this policy may be made at our sole discretion in the following limited circumstances:
- A technical error on our part prevented you from accessing the product
- The product delivered was materially different from what was described
- You contact us within 48 hours of purchase, prior to downloading, and request a refund
To request a refund exception, email contact@evoliahealth.com with your order number and a description of the issue within the relevant timeframe.
Enterprise engagements (discovery calls, custom implementations, research collaborations) are subject to the refund and cancellation terms set forth in the applicable Statement of Work or service agreement.
6. Intellectual Property
All content on the Site and in Evolia Health products — including but not limited to text, graphics, PDFs, templates, checklists, care plans, standard operating procedure frameworks, scientific summaries, training materials, brand elements, product names, and the Evolia Health name and logo — is the proprietary intellectual property of Evolia Health and is protected by applicable U.S. and international copyright, trademark, and other intellectual property laws.
Third-party regulatory and scientific content (such as NIOSH, OSHA, CDC, and NWS materials) is cited and attributed in accordance with applicable use policies for federal government publications. Such content remains the property of its originating agency and is referenced for educational purposes only.
The Evolia Health brand system, zone naming architecture, and product framework are proprietary and may not be reproduced, imitated, or used without express written permission.
7. Permitted Use & License
7.1 CWPS — Organizational Buyers
Upon purchase of a CWPS product, Evolia Health grants the purchasing organization a limited, non-exclusive, non-transferable license to use, adapt, and implement the purchased materials within that organization’s operations at the site(s) covered by the applicable license tier. Permitted uses include:
- Completing fillable fields and adding organization-specific information (name, logo, contact information, site-specific details)
- Printing and distributing to employees or supervisors within your organization
- Using materials in training sessions conducted by or for your organization
- Storing materials on internal organizational systems for employee access
CWPS materials may not be resold, sublicensed, publicly distributed, shared with third parties outside your organization, or used to create competing products or services. Multi-site or enterprise-scale use requires a separate enterprise license. Contact contact@evoliahealth.com for multi-site licensing.
7.2 Site Content
You may access and view Site content for personal, informational purposes. No content on the Site may be reproduced, scraped, redistributed, or used commercially without the prior written consent of Evolia Health.
8. Prohibited Uses
You agree not to use the Site or any Evolia Health product in any way that:
- Violates any applicable federal, state, or local law or regulation
- Infringes or misappropriates the intellectual property rights of Evolia Health or any third party
- Involves reproducing, reselling, or distributing Evolia Health products or materials without authorization
- Involves scraping, indexing, or systematically extracting content from the Site for commercial purposes
- Involves submitting false or misleading information in an inquiry form, purchase, or enterprise intake
- Attempts to gain unauthorized access to Site systems, databases, or infrastructure
- Transmits malware, spam, or any other harmful or disruptive code or content
- Misrepresents an affiliation with Evolia Health, its products, or its founder
- Uses Evolia Health materials to represent that your organization has received external certification, regulatory approval, or endorsement that it has not received
9. No Medical or Legal Advice
Evolia Health products and Site content are for educational and informational purposes only. They do not constitute medical advice, emergency medical guidance, legal advice, or regulatory compliance certification.
Evolia Health’s founder holds a Doctor of Public Health (DrPH) degree and operates as a public health scientist. Evolia Health is not a medical practice, a law firm, or a regulatory compliance service. Nothing on the Site or in any Evolia Health product creates a physician-patient relationship, attorney-client relationship, or any other professional service relationship.
In a medical emergency, call 9-1-1 immediately. Do not solely rely on any Evolia Health product as your primary source of emergency guidance when a person’s life may be at risk.
Employers and organizations using CWPS products are solely responsible for ensuring that their workplace health and safety programs comply with all applicable laws, regulations, and standards, including OSHA requirements and any applicable state or local standards. Evolia Health products are tools to support program development — they do not guarantee compliance and should be reviewed by qualified legal counsel and safety professionals before implementation.
10. Content Accuracy & Regulatory Currency
Evolia Health is committed to grounding all scientific and regulatory content in primary, peer-reviewed, and federal agency sources (including NIOSH, OSHA, CDC, NWS, and AAP). Citations and source attributions are included in our products to allow verification.
Regulatory standards, agency guidance, and public health recommendations are subject to change. Evolia Health products reflect standards and guidance as of the date indicated on the product or document. Evolia Health reviews and updates products periodically; however, we cannot guarantee that content reflects the most current regulatory or scientific standards at all times.
Users of CWPS products are responsible for monitoring applicable OSHA regulations, state plans, and relevant guidance for updates after the product’s publication date. Evolia Health recommends that organizational users verify regulatory currency with qualified legal and safety counsel before implementation.
11. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EVOLIA HEALTH PROVIDES THE SITE, ITS CONTENT, AND ALL PRODUCTS AND SERVICES “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.
Evolia Health does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Evolia Health does not warrant that any product or material will prevent injury, illness, heat-related illness, or other adverse outcomes. The effectiveness of any health and safety program depends on factors beyond Evolia Health’s control, including implementation, adherence, local conditions, and individual circumstances.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EVOLIA HEALTH, ITS FOUNDER, OFFICERS, AFFILIATES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY PRODUCT, OR ANY SERVICE — INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR BUSINESS INTERRUPTION — EVEN IF EVOLIA HEALTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL EVOLIA HEALTH’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ANY PRODUCT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO EVOLIA HEALTH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages. In such jurisdictions, the limitations above apply to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Evolia Health and its founder, officers, agents, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of the Site or any Evolia Health product in violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party intellectual property or other right
- Any misrepresentation you make in connection with an enterprise inquiry or purchase
- Your organization’s implementation of a CWPS product, including any failure to verify regulatory compliance
14. Third-Party Links & Resources
The Site and Evolia Health products may reference or link to third-party websites and resources, including federal agency websites (OSHA, NIOSH, CDC, NWS), academic publications, and supplier or equipment vendors. These links and references are provided for informational convenience only.
Evolia Health does not endorse and is not responsible for the content, accuracy, products, services, or practices of any third-party website or resource. Access to third-party sites is governed by their own terms and conditions. Evolia Health does not receive compensation for linking to third-party resources unless explicitly disclosed.
15. Enterprise & Organizational Terms
Organizations, government entities, and institutional buyers of CWPS products or custom services are subject to the following additional terms:
15.1 Discovery Call & Intake Forms
Information submitted via the CWPS Enterprise Discovery Call Intake Form is confidential and is used solely to prepare for your discovery call. Submission of the intake form does not create a binding contract or commitment by either party. Engagement terms are established through a separate signed agreement.
15.2 Customization Rights
CWPS purchasers may customize materials as described in Section 7.1. Customized versions of Evolia Health materials remain subject to these Terms. You may add your organization’s name, logo, and site-specific information. You may not remove Evolia Health attribution, credit, or copyright notices from the underlying materials.
15.3 Multi-Site Licensing
A single CWPS product purchase covers one organizational entity. Use across multiple distinct legal entities, municipal departments as separate contracting units, or sites governed by independent safety programs requires a separate multi-site or enterprise license agreement. 15.4 No Guarantee of Regulatory Compliance
Evolia Health products are designed to support the development of compliant occupational health programs. They do not guarantee that your program meets all applicable OSHA, state plan, or local regulatory requirements. The purchasing organization is solely responsible for independent verification of compliance by qualified legal and safety professionals.
16. Governing Law
These Terms and any disputes arising from or related to them are governed by the laws of the State of Florida, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17. Dispute Resolution
In the event of a dispute arising from or related to these Terms or your use of Evolia Health products or services, the parties agree to first attempt to resolve the dispute informally by contacting Evolia Health at contact@evoliahealth.com with a written description of the dispute. Evolia Health will attempt to respond within fifteen (15) business days.
If informal resolution is unsuccessful, any dispute shall be submitted to binding arbitration in Manatee County, Florida, under the rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm.
You agree to resolve disputes with Evolia Health individually and not as part of a class action, collective action, or representative proceeding. You waive any right to a class action or class-wide arbitration.
Note: Arbitration and class action waiver clauses have important legal implications. Evolia Health recommends that enterprise buyers and organizations review this section with qualified legal counsel before entering into an engagement.
18. Changes to These Terms
Evolia Health reserves the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page and, where appropriate, provide additional notice. Your continued use of the Site or any Evolia Health product after the effective date of updated Terms constitutes your acceptance of the changes.
We recommend bookmarking this page and reviewing it periodically. For enterprise buyers with active service agreements, changes to these Terms will not affect the terms of your signed agreement unless otherwise agreed in writing.
